Suspect Arrested for Stopping DUI Investigation by Cursing at Police

Officers asked the passenger in an automobile to wait safely on a sidewalk while field sobriety tests were completed by the driver. The passenger continued to interrupt, leave the sidewalk and then began screaming obscenities at the driver and officers. After several ignored warnings, officers arrested the passenger on charges of disorderly intoxication and resisting arrest without violence. RESULT: The defense filed a motion to suppress challenging the facts surrounding the stop, detention and seizure of the client. After reviewing the attorney’s motion, the State decided to DROP all the charges!
